Terms of Service

These terms are an agreement between you (the business owner, "you") and Builtapage, operated by David Liang in Orange County, California ("Builtapage," "we," "us"). You accept these terms when you check the box at checkout and start your subscription.

1. What you get

For your subscription fee, Builtapage provides:

Before launch, you get up to two rounds of revisions. Please review your site's wording, photos, and details before it goes live and tell us if anything is wrong; some of the wording is drafted with the help of AI tools and may contain mistakes. After launch, you can send up to two small change requests per month, and we'll make each one within two business days. Bigger changes, like additional pages, a redesign, online booking, online stores, or Google Business Profile setup, are quoted separately before any work begins.

2. Free trial

New subscriptions include a 30-day free trial. You enter a payment card at checkout, but you won't be charged during the trial. If you don't cancel before the trial ends, your card is charged automatically on day 31 and then at the start of each billing period after that. We'll send you a reminder email about a week before your trial ends.

Promotional offers apply only as stated at the time you sign up. A promotion may replace the free trial. For example, founding-client pricing gives three months free on the monthly plan instead of the 30-day trial.

3. Price and billing

We may change the price for future billing periods with at least 30 days' notice by email or text. You can cancel before the change takes effect.

4. Cancel anytime

You can cancel at any time, for any reason, in either of these ways:

When you cancel, your site stays live through the end of the billing period you've already paid for (the month on the monthly plan, the year on the yearly plan). We don't refund partial periods. If you cancel during the free trial, you won't be charged at all.

After your service ends, the site is taken offline unless you've bought it out (see section 7). If you ask within 30 days, we'll send you a copy of your site's text and photos at no charge.

5. Missed payments

If a payment fails, Stripe will automatically retry your card and email you a link to update it. If payment is still not received within 14 days, we may take your site offline until the balance is paid. Paying the balance restores your site.

6. Who owns what

Content from your existing listings. We may build your site from information already published about your business, such as your Google Business Profile, including photos, reviews, hours, and services. By subscribing, you authorize us to use that content on your site and confirm you have the right to let us use it. You can ask us to remove anything at any time.

Portfolio. We may show your site as an example of our work on builtapage.com. Tell us if you'd rather we didn't.

7. Buyout option

If you want to own the website outright, you can buy it at any time while your subscription is active for a one-time fee of $950. The buyout includes:

The buyout does not include hosting, updates, lead forwarding, setup on another host, or support. Once purchased, your subscription ends and you're responsible for hosting the site yourself.

If we change the buyout price in the future, the price in effect when you signed up still applies to you.

Your site includes a small "Site by Builtapage" link in the footer. If you buy out your site, you can remove it.

10. Limits on our responsibility

We work hard to keep your site online and working, but we can't guarantee it will be available 100% of the time or free of errors, since it relies on third-party services like hosting and email providers.

To the extent the law allows, our total responsibility for any claim related to this service is limited to the amount you paid us in the three months before the claim. We aren't responsible for lost business, lost profits, or indirect damages.

You agree to cover our costs, including reasonable legal fees, if someone makes a claim against us because of content you supplied or approved for your site, or because of how you run your business.

11. When we can end service

We may end service with 30 days' notice for any reason, or immediately if the site is used for illegal, harmful, or deceptive purposes. If we end service without cause, we'll refund any unused prepaid time and transfer your domain to you if you ask.

12. Changes to these terms

We may update these terms with at least 30 days' notice by email or text. If you keep your subscription after the change takes effect, the new terms apply. Your buyout price stays at the price in effect when you signed up.

13. Governing law

These terms are governed by the laws of the State of California. If we have a dispute, we'll both first try to resolve it informally for 30 days after one of us raises it in writing. If that doesn't work, either of us may bring the claim in the courts of Orange County, California, including small claims court.

14. Privacy and your leads

Quote requests and messages sent through your site include your visitors' names, phone numbers, and other details. We use them only to deliver them to you and to keep your site working, and we never sell them. They pass through the service providers we use to run your site, such as Cloudflare for hosting and spam protection and Resend for email. Our privacy policy at builtapage.com/privacy describes this, and your site links to it.
